Welcome to Trackley. These Terms & Conditions (the “Terms”) govern your access to and use of the Trackley mobile app, websites, and related services (together, the “Service”). By using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.
1. Who we are
The Service is operated by Trackley (“Trackley”, “we”, “us”, or “our”). You can reach us any time at support@trackley.app.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the Service. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or guardian.
3. Your account
Some features can be used without an account. Where you do create an account, you are responsible for keeping your login details secure and for all activity that happens under your account. Let us know promptly if you believe your account has been used without your permission.
4. Using the Service
Trackley is a habit and goal tracker. When using it, you agree not to:
- break any applicable law, or infringe anyone else’s rights;
- access, tamper with, or use non-public areas of the Service or our systems;
- probe, scan, or test the vulnerability of the Service, or defeat any security or authentication measures;
- interfere with or disrupt the Service, for example by sending automated or excessive requests;
- use the Service to send spam, malware, or otherwise harmful or unlawful content.
5. Your content
You keep ownership of the goals, notes, and other content you add to Trackley (“Your Content”). You grant us a limited licence to host, store, and display Your Content solely to operate and improve the Service for you. You are responsible for Your Content and for making sure you have the rights to share it.
6. Our intellectual property
The Service itself — including its software, design, companions, logos, and branding — belongs to Trackley and is protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial use, subject to these Terms.
7. Subscriptions and payments
Trackley is free to start. If we offer paid features, the price, billing period, and renewal terms will be shown to you before you purchase, and any purchase made through an app store is also subject to that store’s terms. Except where required by law, payments are non-refundable.
8. Changes to the Service
We are always improving Trackley, so we may add, change, or remove features over time. We may also suspend or discontinue the Service, in whole or in part, where reasonable to do so.
9. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties about the Service and disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Trackley supports habit building and is not a medical, psychological, financial, or other professional service.
10. Limitation of liability
To the fullest extent permitted by law, Trackley will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill arising from your use of the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including consumer-law guarantees.
11. Termination
You may stop using the Service at any time. We may suspend or end your access if you breach these Terms or if we reasonably need to in order to protect the Service or other users. Provisions that by their nature should survive termination will continue to apply.
12. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we’ll take reasonable steps to let you know, such as by updating the date above or notifying you in the app. By continuing to use the Service after changes take effect, you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of Australia, without regard to conflict-of-laws principles, and you agree to the non-exclusive jurisdiction of the courts located there. You may also have rights under the laws of your own country that these Terms do not affect.
